E-2 Treaty Investor Qualifications

Foreign nationals (or qualifying organizations) from countries with which the U.S. has a commerce and navigation treaty have the opportunity to apply for an E-2 treaty investor visa if they are making a significant investment in a U.S. business. If you are already in the U.S. under another visa classification but qualify for an E-2 visa, you may wish to change your designation.

The general qualifications for E-2 treaty investor classification include:

  • Status as a national of a country that the U.S. has a commerce and navigation treaty with
  • Placing or investing significant assets or capital into a U.S. company or enterprise that is real and operating to produce services or goods for profit
  • Be seeking entry into the U.S. specifically to manage and develop the investment in the U.S. company
  • Having control of operations of the company or at least 50 percent ownership of the company

E-2 visas are granted for an initial period of two years, and extensions are available. There are no limits on the number of extensions available to E-2 visa holders. Furthermore, spouses of the E-2 visa holder and children under 21 who are unmarried may also qualify for E-2 status as dependents.

Employees of the treaty investors and qualifying organizations have different qualifications. They must have the same nationality as the primary E-2 treaty investor, and either be employed in a managerial capacity within the company or possess specialized skills that are essential to the operation of the business in question.
